EU General Product Safety Regulation (GPSR) Changes

In May 2023, the European Union introduced the revamped General Product Safety Regulation (GPSR), emphasizing a need to regulate the increasing number of non-compliant products reaching the EU market via online sales.

This updated regulation serves as a pivotal guide, superseding the General Product Safety Directive (GPSD), and is specifically designed to modernize safety standards for non-food consumer products. Tailored to address contemporary challenges arising from technological advancements, the surge in online sales, and the inefficiencies within existing market surveillance rules, the GPSR aims to provide a comprehensive framework for ensuring product safety in the ever-evolving consumer landscape.

A notable aspect of the GPSR is its attention to the intricacies of product recall effectiveness and the regulation of food-imitating products. It anticipates and addresses challenges stemming from the growing trends of globalization and digitization.

Enforced on June 13th, 2023, the regulation marked its official initiation on the twentieth day post-publication. However, a transition period of 18 months is in place, culminating in the full implementation of the regulation on December 13th, 2024.

For businesses involved in online product sales within the EU, the GPSR introduces a clear definition of an “economic operator,” encompassing manufacturers, authorized representatives, importers, distributors, and fulfillment service providers. This mandates these entities to appoint a responsible person within the EU before importing products. The impact of this provision is particularly significant for companies engaged in online sales, with major players like Amazon set to withdraw their responsible person services by March 31st, 2024.
